Terms of Service

These Terms explain the rules for using TickTaco and the current Free, trial and promotional access model.

About these Terms

These Terms of Service govern your access to and use of TickTaco, including its trading journal, analytics, notes, mental-state tracking, integrations and AI-assisted features (collectively, the “Service”). TickTaco is operated by Tom Warzybok, an individual operating under the TickTaco name. References to “TickTaco,” “we,” “us” or “our” mean Tom Warzybok as the operator of the Service.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 18 years old and legally capable of entering into a binding agreement in your place of residence. If you use TickTaco for an organization, you confirm that you have authority to bind that organization.

You must provide accurate account information and keep it current. You are responsible for safeguarding your password, connected sign-in method and devices, and for activity performed through your account. Tell us promptly at marketing@ticktaco.app if you suspect unauthorized access.

Current access model

  • Free. The Free plan has no scheduled end date and remains available. Its limits, included features and usage allowances may change as the Service develops.
  • One seven-day Premium trial. Each new account receives one free seven-day Premium trial. No payment card is required. The trial does not renew automatically and the account returns to the available Free experience when the trial ends unless other valid access has been granted.
  • Promotional access. Premium access is currently granted free of charge through promotional or access codes distributed by TickTaco, including through the official TickTaco Discord community. Codes may have eligibility, duration, redemption and usage limits. They have no cash value, may not be sold or transferred, and are not paid subscriptions.
  • No public paid subscription today. TickTaco does not currently sell subscriptions to the public, store payment-card data, charge users or automatically renew access.

Permission to use TickTaco

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Service for your own lawful trading-journal and analysis purposes. TickTaco and its software, design, branding and other service materials remain protected by intellectual-property laws. No rights are granted except those expressly stated in these Terms.

Acceptable use

You may use TickTaco only lawfully and in accordance with these Terms. You must not:

  • access another person’s account or data without authorization;
  • upload malicious code or interfere with the Service or its security;
  • probe, scan or test vulnerabilities without our written permission;
  • scrape, reverse engineer or copy the Service except where applicable law permits it;
  • use the Service to violate law, third-party rights or trading-platform rules;
  • misrepresent the origin, ownership or accuracy of data you submit;
  • resell, sublicense or provide unauthorized commercial access to the Service; or
  • use automated activity that creates unreasonable load or disrupts other users.

Trading-platform integrations

TickTaco may let you import or synchronize trading data from MetaTrader 5 (MT5), cTrader and NinjaTrader 8. By enabling an integration or uploading an export, you instruct us to receive and process the data required to provide the requested journal and analytics features. You confirm that you have the right to provide that data.

Third-party platforms, brokers, networks and local integration tools operate independently from TickTaco. Their availability, data quality, delays and terms are outside our control. You are responsible for configuring integrations securely, checking imported records against the source platform and correcting any errors before relying on them.

Your data and content

You retain ownership of the trading records, notes, tags, mental-state assessments, screenshots, prompts and other content you submit to the Service (“User Content”).

You grant TickTaco a worldwide, non-exclusive, royalty-free license to host, store, transmit, format and otherwise technically process User Content only as needed to operate, secure, maintain and support the Service, carry out your instructions and meet legal obligations. This license ends when the relevant content is deleted from our active systems, subject to reasonable backup, security and legal-retention periods. This license does not authorize TickTaco to use your private trading records or notes to train AI models.

AI Mentor and automated output

AI Mentor and related features may use your prompts and selected trading context to generate automated responses. AI output can be inaccurate, incomplete, outdated or unsuitable for your circumstances. You must review it independently before acting on it.

OpenRouter acts as an AI gateway and may forward a request to the selected model provider. That provider processes the prompt and supplied context to generate the response.

AI Mentor does not provide investment recommendations, personalized financial advice, trade signals or instructions to buy, sell or hold any asset. Do not submit information to an AI feature that you do not want processed for that request.

No brokerage or financial advice

TickTaco is a journaling and decision-intelligence tool. It is not a broker, exchange, custodian, portfolio manager, fiduciary or financial, investment, tax or legal adviser. We do not execute trades or control your brokerage account.

Trading involves substantial risk, including loss of capital. You make every trading and risk-management decision yourself and remain solely responsible for verifying information and deciding whether any action is appropriate.

Service changes, limits and experiments

We may add, change, limit or discontinue features, integrations, usage allowances or plan limits. We may test features with a subset of users. Where a change materially reduces an ongoing paid entitlement in the future, any additional terms published for that paid offering will apply.

Suspension, termination and deletion

You may stop using TickTaco at any time and may request account or data deletion by contacting us. We may restrict, suspend or terminate access when reasonably necessary to address a Terms violation, fraud, abuse, security risk, legal requirement, harm to the Service or prolonged inactivity. When appropriate, we will give notice and a reasonable opportunity to resolve the issue.

After termination, your right to use the Service ends. Provisions that by their nature should survive—including ownership, disclaimers, liability limits and dispute provisions—remain effective.

Future payment options

TickTaco is in discussions with potential payment providers and is evaluating options intended to serve users worldwide. This includes traditional payment methods and, for users who prefer digital assets, possible cryptocurrency payment solutions. Technologies built on networks such as XRPL are among the options being considered. No provider, network, asset, wallet integration or launch date has been selected or promised.

If paid access is introduced, we will publish the applicable prices, billing cycle, renewal, cancellation and refund rules before users are asked to make a purchase. Additional terms may apply to any payment option that becomes available.

Availability and third-party services

We aim to keep TickTaco available, but uninterrupted or error-free operation is not guaranteed. Maintenance, security incidents, internet conditions and third-party services may cause delays or downtime. We may use third-party infrastructure and AI providers to deliver parts of the Service. Their services are subject to their own availability and terms.

Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. Nothing in these Terms limits any warranty or consumer right that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by applicable law, TickTaco will not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits, trading losses, lost opportunities, loss of data or business interruption arising from or related to the Service.

TickTaco’s total liability for all claims relating to the Service will not exceed the greater of the amount you paid to TickTaco for the Service during the twelve months before the event giving rise to the claim or US$100 (or its local-currency equivalent). These limits do not apply where liability cannot be limited by law.

Changes to these Terms

We may update these Terms as the Service or legal requirements change. We will post the revised Terms with a new “Last updated” date and, when required, provide additional notice. Continuing to use the Service after the effective date means you accept the updated Terms, except where applicable law requires another form of consent.

Applicable law and contact

Applicable law, including any mandatory consumer protections, governs these Terms. Nothing here limits rights you cannot waive under the law that applies to you. Any dispute must be brought in a court or forum with jurisdiction under applicable rules.
